1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of aloka’s mobile application, website, and related services (together, the “Services”).
The Services are operated under the aloka name (“aloka,” “we,” “us,” or “our”).
By downloading, accessing, or using aloka, you agree to these Terms. If you do not agree, do not use the Services.
2. What aloka Does
aloka is a mobile application that helps people living alone and trusted people around them stay connected through simple daily check-ins.
Users can:
- Create an account;
- Set check-in reminders;
- Confirm that they are okay;
- Add trusted contacts or Family Circle members;
- Receive reminders;
- Allow trusted people to receive alerts if a check-in is missed;
- Manage subscription-based features.
aloka is designed to support care, independence, and peace of mind.
3. Important Safety Disclaimer
aloka is not an emergency service, medical device, healthcare provider, alarm monitoring company, rescue service, professional care service, or substitute for emergency assistance.
aloka does not guarantee that:
- A user is safe;
- A user is in danger;
- A reminder will always be displayed;
- A notification, email, or SMS will always be delivered;
- A trusted contact will see or respond to an alert;
- A missed check-in means an emergency occurred;
- A completed check-in means that no emergency exists.
If you believe that you or someone else is in immediate danger, contact local emergency services directly.
4. No Medical or Professional Advice
aloka does not provide medical advice, diagnosis, treatment, emergency assessment, mental health support, or professional caregiving advice.
Any information provided through the Services is for general informational and functional purposes only. You should not rely on aloka as your only safety measure.
5. Eligibility
You may use aloka only if you are legally able to enter into these Terms and are not prohibited from using the Services under applicable law.
If you use aloka on behalf of another person, you represent that you have the appropriate authority, permission, or lawful basis to do so.
6. Account Registration
To use certain features, you may need to create an account. You agree to:
- Provide accurate and complete information;
- Keep your account information updated;
- Protect your login credentials;
- Notify us of unauthorized access;
- Use the Services only for lawful purposes.
You are responsible for activity under your account.
7. Family Circle and Trusted Contacts
aloka allows users to add, invite, or connect with trusted people, such as family members, friends, neighbors, or caregivers.
You agree that:
- You will not add or invite people in a misleading, abusive, harassing, or unlawful way;
- You will not use aloka to control, stalk, pressure, or monitor another person without proper permission;
- You will respect the privacy and independence of people connected through aloka;
- You are responsible for ensuring that contact information you provide is accurate and appropriate;
- Trusted contacts are not professional emergency responders unless separately arranged outside aloka.
We may remove or restrict Family Circle relationships if we believe the feature is being misused.
8. Check-Ins, Reminders, and Alerts
aloka may provide reminders, check-in buttons, missed check-in alerts, Family Circle notifications, and related features.
You understand and agree that:
- Reminders and alerts depend on device settings, operating system behavior, internet connection, notification permissions, battery settings, app permissions, third-party services, and other factors outside our control;
- Alerts may be delayed, fail to deliver, or not be seen by the recipient;
- Users and trusted contacts must not rely on aloka as the only way to verify safety;
- You are responsible for keeping your phone, app permissions, contact details, and notification settings properly configured;
- If a real emergency is suspected, emergency services should be contacted directly.
9. Device Permissions
Some features may require device permissions, such as notifications or other permissions needed for reminders, alerts, or app functionality.
If you deny or disable permissions, some features may not work properly. You can manage permissions through your device settings.
Unless explicitly requested and approved, aloka does not rely on constant location tracking as part of its core functionality.
10. Acceptable Use
You agree not to:
- Use aloka for unlawful, harmful, abusive, or fraudulent purposes;
- Use aloka to harass, stalk, threaten, control, or pressure another person;
- Add false or misleading contact information;
- Misrepresent your identity or relationship to another person;
- Attempt to access another user’s account;
- Interfere with the operation or security of the Services;
- Reverse engineer, copy, modify, or create derivative works of the Services, except where legally permitted;
- Use automated systems to abuse or overload the Services;
- Violate applicable laws or third-party rights.
We may suspend or terminate access if we believe you violated these Terms.
11. Subscriptions, Trials, and Payments
aloka may offer free trials, monthly subscriptions, yearly subscriptions, promotional access, or paid features.
Subscription terms, pricing, billing periods, trial duration, renewal rules, cancellation rules, and refund rules may be displayed in the app, app store, or checkout flow.
If you purchase through Google Play or Apple App Store, billing, renewal, cancellation, and refunds are generally managed by the relevant app store according to its terms.
You are responsible for cancelling a subscription before renewal if you do not want to continue. Deleting the app may not cancel your subscription.
12. Promo Codes and Beta Access
We may offer promo codes, beta access, discounts, free trial periods, or limited-time access. We may modify, suspend, or terminate promotional access at any time unless otherwise required by law or expressly stated.
Promo codes may be subject to eligibility, duration, region, and usage limits.
13. Refunds
Refunds for purchases made through app stores are generally handled by Google Play or Apple App Store according to their policies.
We do not guarantee refunds unless required by applicable law or explicitly stated in a separate written agreement.
14. User Content and Feedback
You may provide feedback, comments, support messages, suggestions, or other content. You represent that you have the right to provide such content.
You grant us a non-exclusive, worldwide, royalty-free license to use feedback and suggestions to improve aloka, without obligation to compensate you.
You must not submit content that is unlawful, abusive, misleading, infringing, or harmful.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using aloka, you acknowledge that you have read and understood the Privacy Policy.
16. Third-Party Services
The Services may rely on or integrate with third-party services, such as authentication providers, app stores, subscription management providers, analytics services, notification providers, email/SMS providers, hosting providers, and crash reporting tools.
We are not responsible for third-party services, their availability, their terms, or their privacy practices. Your use of third-party services may be subject to their own terms and policies.
17. App Stores
If you download aloka from Google Play, Apple App Store, or another app store, you may also be subject to that app store’s terms and policies.
The app store provider is not responsible for providing support or maintenance for aloka unless required by applicable app store terms.
18. Availability and Changes to the Services
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free operation.
We may modify, suspend, restrict, discontinue, or update the Services or any feature at any time. We may also release updates that must be installed to continue using the Services.
19. Data Accuracy and User Responsibility
aloka depends on accurate information and correct device configuration.
You are responsible for:
- Providing accurate contact information;
- Updating outdated information;
- Keeping trusted contact details correct;
- Maintaining internet access where needed;
- Allowing necessary permissions;
- Ensuring that trusted contacts understand their role;
- Using aloka as one safety layer, not the only safety measure.
20. Limitation of Liability
To the fullest extent permitted by law, aloka and its owners, directors, officers, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of profits, loss of goodwill, personal injury, missed alerts, delayed notifications, failed communications, or failure of a trusted contact to respond.
To the fullest extent permitted by law, our total liability for claims related to the Services will be limited to the amount you paid to use the Services during the twelve months before the claim arose, or EUR 50, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
21. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.
We do not warrant that aloka will prevent harm, detect emergencies, guarantee safety, or ensure that alerts are delivered or acted upon.
22. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless aloka and its owners, directors, officers, employees, contractors, partners, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your use of the Services;
- Your violation of these Terms;
- Your violation of applicable law;
- Your misuse of Family Circle or trusted contact features;
- Information you provide;
- Your infringement of third-party rights.
23. Suspension and Termination
We may suspend or terminate your access to the Services if:
- You violate these Terms;
- You misuse the Services;
- We detect fraud, abuse, or security risk;
- Required by law;
- We discontinue the Services.
You may stop using aloka at any time. You may request account deletion as described in the Privacy Policy.
Termination does not automatically cancel subscriptions purchased through app stores. You may need to cancel subscriptions separately through the relevant app store.
24. Intellectual Property
aloka, including its name, logo, design, software, features, text, graphics, and other content, is owned by us or our licensors and is protected by intellectual property laws.
You receive a limited, personal, non-exclusive, non-transferable, revocable license to use aloka according to these Terms.
You may not copy, modify, distribute, sell, lease, reverse engineer, or exploit the Services except as permitted by law or expressly authorized by us.
25. Governing Law
These Terms are governed by the laws of Republic of Moldova, without regard to conflict of law principles.
If you are a consumer, you may also have rights under mandatory consumer protection laws in your country of residence.
26. Dispute Resolution
Before starting formal legal proceedings, you agree to contact us at hello@aloka.live and try to resolve the dispute informally.
If we cannot resolve the dispute informally, disputes will be handled by the competent courts of Republic of Moldova, unless applicable law gives you the right to bring proceedings elsewhere.
27. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may notify you through the app, by email, or by other appropriate means.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
28. Severability
If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect.
29. No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
